2. Service Provider and contact

The Service Provider is Contextadmin, ul. Elbląska 30, 10-267 Olsztyn, Poland, VAT ID PL7393219910.

Contact for matters relating to the Service: hello@agentichosting.net.

The ContextAdmin Panel (software described at contextadmin.com) is available at the individual address provided to the Customer after the account is launched.

3. Type and scope of the Service

The Service consists of providing the Customer with a hosting environment in a separate Incus system container. The container includes its own system, its own Docker, assigned CPU cores, a guaranteed RAM limit and a disk limit according to the selected plan.

The Customer does not share processes, files or Docker with other customers. The Service is provided on dedicated servers in Hetzner data centres in Germany or Finland and OVHcloud data centres in the European Union. Data is stored in the European Union.

As part of the Service, the Customer receives access to the Panel, where the Customer may in particular:

  • create and launch Projects in Docker;
  • use AI agents in a browser-based terminal;
  • launch ready-made templates, including WordPress, PrestaShop, WooCommerce through WordPress, Magento, Shopware, Sylius, OpenCart, Drupal, Joomla, TYPO3, Moodle, Node.js, PHP with databases, PHP with nginx and other stacks available through Docker;
  • publish Projects on the Customer’s own domains with a Let’s Encrypt SSL certificate;
  • use email in the Customer’s domains and Roundcube webmail;
  • use DNS zones;
  • manage Git, backups, task schedules, monitoring, files, SFTP and a team;
  • use the Panel in Polish or English.

The Service does not include the cost of any AI subscription or AI model usage. The Customer pays these costs directly to the AI Provider.

4. Technical requirements

To use the Service, the Customer needs:

  • a device with Internet access;
  • an up-to-date web browser supporting HTTPS;
  • an active email address;
  • the ability to receive email messages from the Service Provider;
  • for online payments, a payment method supported by Stripe Checkout;
  • for using AI agents, an active subscription or API key with an AI Provider supported by the Panel;
  • for publishing a Project on the Customer’s own domain, access to the DNS settings of that domain.

The Customer is responsible for correctly setting DNS records if the Customer wants to publish a Project under the Customer’s own domain.

5. Conclusion of the agreement

  1. The Customer enters into an agreement for the provision of the Service by selecting a plan and placing an order online.
  2. Payment is processed through Stripe Checkout. Available payment methods depend on Stripe.
  3. The Customer may provide a VAT ID at payment. The invoice is issued automatically.
  4. The agreement is concluded when the order is successfully paid for, unless the order process clearly states otherwise.
  5. After the payment is credited, the Service Provider launches the account within 1 business day. Preparing the environment itself usually takes about 2 minutes, but the maximum account launch time is 1 business day.
  6. The Customer receives the Panel address and login details by email.

6. Subscription, automatic renewal and cancellation

The Service is provided as a monthly or annual subscription. The annual subscription is charged at the price of 10 months.

The subscription renews automatically for the next Billing Period unless the Customer cancels renewal before the end of the current Billing Period.

The Customer may cancel the Service at any time from the Stripe panel. Cancellation takes effect at the end of the paid Billing Period. Until the end of that period, the Customer may use the Service, unless there are grounds to suspend or terminate the Service in accordance with these Terms.

The absence of a fixed-term agreement means that the Customer is not obliged to use the Service for longer than the selected and paid Billing Period.

The renewal price is the same as the price of the selected plan applicable at the time of order, without first-period promotions and without hidden add-ons.

8. 30-day money-back guarantee

The Customer may use the 30-day money-back guarantee, counted from the date of conclusion of the agreement.

To use the guarantee, the Customer should contact the Service Provider at hello@agentichosting.net and provide information allowing the payment and account to be identified.

The money-back guarantee applies to the fee for the Service collected by the Service Provider. It does not cover costs incurred by the Customer with AI Providers or other external service providers with whom the Customer enters into separate agreements.

If the Customer who is a Consumer or an Entrepreneur with consumer rights also has a statutory right to withdraw from the agreement, the Customer may use the right that is more favourable to the Customer.

9. Right of withdrawal from the agreement

A Consumer and an Entrepreneur with consumer rights may withdraw from the agreement within 14 days from its conclusion without giving any reason.

To meet the deadline, it is sufficient to send the withdrawal statement before the deadline expires. The statement may be sent by email to hello@agentichosting.net.

The Customer may request that the provision of the Service begins before the end of the 14-day withdrawal period. Placing an order and paying for a Service that is to be launched within 1 business day constitutes a request to begin providing the Service before the withdrawal period expires.

If the Customer withdraws from the agreement after the Service has begun at the Customer’s request, the Service Provider may charge an amount proportionate to the scope of the service performed up to the time of withdrawal. If the 30-day money-back guarantee applies in a given case, the Service Provider applies the rules more favourable to the Customer.

After effective withdrawal from the agreement, the Service Provider refunds the payment for the Service in accordance with the law, taking into account the rules above.

10. Use of the Panel and Projects

The Customer uses the Panel to create, improve, launch and publish Projects. Projects are launched in Docker. The Panel may assign a port, expose the Project through nginx with HTTPS and an optional password, and issue a Let’s Encrypt certificate for the domain indicated by the Customer.

The Customer may create Projects from templates or from scratch. The Customer is responsible for decisions concerning the choice of technology, content, configuration, publication and operation of the Customer’s Projects.

The Panel provides tools that increase work safety, including Git, backups, rollback of changes, project boundaries, anonymisation of personal data in databases and the ability to work on copies. Use of these tools requires action by the Customer.

11. AI subscriptions on the Customer’s side

The cost of using AI models is not included in the price of the Service.

The Customer connects the Customer’s own subscription or API key with an AI Provider in the Panel, in particular Claude, ChatGPT, Codex or opencode with a selected provider.

The agreement concerning the AI model, AI subscription, API key, limits, billing, data processing by the AI Provider and liability of the AI Provider is concluded directly between the Customer and the AI Provider. The Service Provider does not add any margin to AI costs and is not a party to that agreement.

The Customer may change the AI Provider at any time, provided that the Panel supports the selected integration method.

12. Customer responsibility for content and AI Agent actions

The Customer is responsible for content, data, files, code, databases, configurations, email messages and other materials placed, created, processed or published within the Customer’s account.

The Customer is also responsible for the actions of AI Agents launched on the Customer’s account, including instructions given to AI Agents, code generated by AI Agents, changes in Projects, container configuration, content published in Projects and data transferred to AI Providers.

An AI Agent may work in the terminal after the browser has been closed. The Customer should supervise its work, verify results and use tools such as Git, backups, tests, code review and test environments.

The Customer should not provide an AI Agent with data that the Customer does not want to or cannot provide to the AI Provider under the Customer’s agreement with that AI Provider.

13. Fair Use of resources

The Service is provided within the parameters of the selected plan: CPU, RAM, disk, number of user accounts, email domains and DNS zones, and email mailboxes.

Projects are available without a numerical limit within the resources of the plan. Traffic is available with no per-GB fees within Fair Use.

The Customer should use the Service in accordance with its intended purpose, that is, for hosting websites, stores, applications, tools and project environments. The Customer may not use the Service in a way that causes excessive or unjustified load on the infrastructure, or disrupts the Service, network, email, DNS or services of other customers.

A breach of Fair Use rules includes in particular using the Service beyond the allocated plan limits, bypassing technical limits, generating excessive traffic unrelated to the typical operation of hosted Projects, maintaining harmful or prohibited processes, and actions listed in these Terms as prohibited.

In the event of a breach of Fair Use rules, the Service Provider may request that the Customer changes the way the Service is used, propose a plan change, limit the effects of the breach, suspend an element of the Service or suspend the account if this is necessary to protect the infrastructure, security or other customers.

14. Prohibited content and actions

The Customer may not use the Service for unlawful activities, activities infringing the rights of third parties, activities breaching these Terms or activities threatening the security of the infrastructure.

In particular, the following are prohibited:

  • sending spam or operating infrastructure used for spam;
  • placing, creating, launching or distributing malware, viruses, ransomware, backdoors, botnets or similar software;
  • cryptocurrency mining;
  • carrying out attacks on systems, networks, applications or accounts of third parties;
  • scanning, breaking security, attempts at unauthorised access or security tests carried out without authorisation;
  • phishing, impersonating other entities or fraudulently obtaining data;
  • infringing copyrights, industrial property rights, personal rights or legally protected secrets;
  • publishing unlawful content;
  • actions disrupting email, DNS, network, the Panel, the server or services of other customers;
  • bypassing plan limits or technical safeguards;
  • sharing the account with unauthorised persons.

The Service Provider may block or suspend an element of the Service, a Project or an account if this is necessary to stop a breach, protect the infrastructure, protect other customers, comply with a legal obligation or limit damage.

15. Backups

The Panel provides tools for creating backups, including database dumps, Docker volume archives, scheduling and rsync transfer to a second server or to FTP.

The Customer is responsible for setting up, checking and maintaining backups of the Customer’s Projects, data, databases, files, configurations and email to the extent necessary to conduct the Customer’s activity.

The Customer should regularly check whether backups are being created correctly and whether they can be restored.

The Service Provider provides backup tools in the Panel but does not take over the Customer’s responsibility for having current copies of data needed for the operation of Projects.

16. Email and DNS

As part of the plan, the Customer receives email mailboxes in the Customer’s domains, an email server, Roundcube webmail and DNS zones according to the parameters of the selected plan.

Login to email and DNS may take place from the Panel through the “Email” and “DNS” buttons without a separate password, in an SSO model.

The Customer is responsible for the content of email messages sent and received through the Customer’s mailboxes and for the configuration of domains and DNS records.

17. Technical breaks and maintenance

The Service Provider may carry out technical, maintenance, update and administrative work concerning the Panel, infrastructure, servers, network, email, DNS or security elements.

Technical work may cause temporary unavailability of all or part of the Service. The Service Provider makes efforts to carry out work in a way that limits the impact on use of the Service.

The Service Provider may carry out urgent work without prior notice if this is necessary for the security, stability or continuity of operation of the Service.

18. Non-payment, suspension and deletion of data

If payment for the next Billing Period is not successfully collected or paid, the Service Provider may suspend provision of the Service.

During the suspension period, access to the Panel, Projects, email, DNS or other elements of the Service may be limited or disabled.

If the overdue amount is not paid within 14 days from the date of non-payment for the Service, the Service Provider may delete the Customer’s account together with data, Projects, the container, files, databases, email, configuration and backups available within the Service.

The Customer should download any data the Customer wants to keep before termination or suspension of the Service.

19. Support

Support is provided according to the selected plan.

  • AGENT START: email support, response time 1 business day.
  • AGENT PRO: email support, response time 1 business day, priority.
  • AGENT BUSINESS: email support and a 30-minute implementation consultation, response time 4 business hours.

Response time means the time for the Service Provider’s first response during the business hours applicable to the given plan. It does not mean a guaranteed time to resolve the matter.

20. Complaints

The Customer may submit a complaint concerning the Service by email to hello@agentichosting.net.

The complaint should include information allowing the Customer to be identified, a description of the problem, the date on which it occurred and the expected method of handling the complaint.

The Service Provider responds to the complaint within 14 days from the date of receipt.

If the complaint does not contain the information needed to handle it, the Service Provider may ask the Customer to supplement it.

21. Service Provider liability

The Service Provider is responsible for providing the Service in accordance with these Terms, the selected plan and applicable law.

The Service Provider is not responsible for the Customer’s content, the Customer’s actions, actions of users added by the Customer, actions of AI Agents launched by the Customer, decisions of AI Providers, operation of AI models, AI subscription costs or the effects of the Customer providing data to an AI Provider.

The Service Provider is not responsible for errors in the code, configuration, content or data of a Project to the extent that they result from actions of the Customer, the Customer’s users, AI Agents or AI Providers.

The Service Provider does not promise unlimited resources, a specified SLA level or automatic compliance of the Customer’s Projects with legal requirements.

22. Personal data protection

The rules for processing personal data by the Service Provider as controller, in particular contact data, billing data and data related to servicing the Customer’s account, are described in the privacy policy available on the Service Provider’s website.

For privacy matters, the Service Provider may be contacted at hello@agentichosting.net.

The Customer acknowledges that AI Providers and Stripe may process data on the basis of their own rules and their own agreements concluded with the Customer or related to payment.

23. Entrustment of personal data processing

If the Customer processes personal data in the Customer’s Projects, databases, files, email, backups or other resources maintained within the Service, the Customer is the controller of that data or acts in another role specified by data protection laws.

To the extent that the Service Provider stores or otherwise processes such personal data as part of providing the Service, the Customer entrusts the Service Provider with the processing of personal data on the terms described in these Terms.

The subject of the entrustment is the processing of personal data placed by the Customer within the Service, including in Projects, databases, files, configuration, email and backups.

The purpose of the entrustment is to provide the Service, including maintaining the hosting environment, Panel, container, Docker, email, DNS, backups, monitoring, SFTP access and other functions covered by the selected plan.

The duration of the entrustment corresponds to the period of provision of the Service and the period needed to delete data after the Service ends or expires.

The type of personal data and categories of data subjects depend on the data entered by the Customer. They may include data of website users, store customers, message recipients, employees, associates, contractors or other persons whose data the Customer places in the Service.

The Service Provider processes entrusted data solely for the purpose of providing the Service and in accordance with the Customer’s documented instructions resulting from these Terms, the configuration of the Service and the Customer’s actions in the Panel.

The Service Provider applies technical and organisational measures appropriate to the nature of the Service, including separation of customer containers, assigned resources, disk limits, HTTPS, access through the Panel, backup tools, fail2ban, hardened PHP in templates and mechanisms limiting the scope of an agent’s work to the project directory.

The Customer is responsible for the compliance of the Customer’s Projects with data protection laws, including the legal bases for processing, information obligations, the content of privacy policies, and the configuration of forms, consents, user accounts, access permissions, logs and data transferred to AI Providers.

The Service Provider may use Hetzner and OVHcloud infrastructure in the European Union. Data within the Service is stored in the European Union.

After the end of the Service, the Service Provider deletes data in accordance with these Terms, in particular the rules concerning deletion of data after non-payment for the Service. The Customer should download in advance any data the Customer wants to keep.

24. Account security

The Customer is responsible for keeping confidential login details, API keys, passwords, deployment tokens, SFTP access, Git access, Panel access, email access and access details for AI Providers.

The Customer should grant access only to authorised persons and remove it when it is no longer needed.

Each Panel user in a team should use their own account and their own AI subscription if they use AI Agents.

25. Partner programme

The Service Provider may operate a partner programme in which the referrer receives 20% of each payment made by the referred customer for 12 months.

Settlement of the partner programme takes place after email contact with the Service Provider.

26. Changes to the Terms

The Service Provider may change these Terms for important reasons, in particular in the event of changes in the law, changes in Service functions, changes in the method of providing the Service, changes in plan parameters, changes in infrastructure, changes in payment rules, changes in security requirements or the need to clarify provisions of the Terms.

The Service Provider informs the Customer of changes to the Terms in a way that allows the Customer to review the changes, in particular by email or through the Panel.

Changes to the Terms concerning a Service provided in a subscription model enter into force on the date indicated by the Service Provider, not earlier than 14 days after informing the Customer, unless the law or the nature of the change requires a shorter period.

If the Customer does not accept the amended Terms, the Customer may cancel renewal of the Service with effect at the end of the current Billing Period.

27. Final provisions

These Terms are governed by Polish law.

In matters not regulated by these Terms, Polish law applies, in particular the Civil Code, the Act on the Provision of Electronic Services, the Consumer Rights Act and personal data protection laws.

The provisions of these Terms do not limit the rights of a Consumer or an Entrepreneur with consumer rights arising from mandatory provisions of law.

If any provision of these Terms proves invalid or ineffective, the remaining provisions remain in force.

These Terms apply from 25 October 2026.
